Judge dismisses defamation lawsuit against actor John Travolta

(Reuters) - John Travolta has scored another legal victory with the dismissal of a defamation lawsuit filed by a Los Angeles man who wrote a book alleging he had gay encounters with the film star.

A judge in Los Angeles Superior Court on Thursday dismissed the defamation lawsuit against Travolta and his lawyer, Martin Singer, filed by Robert Randolph.

The author of "You'll Never Spa in This Town Again," published in February 2012, claimed the actor and lawyer spread false statements about his mental health in 2010 in an effort to dissuade the public from buying his upcoming book, according to court documents obtained by Reuters.

Judge Malcolm Mackey on Thursday dismissed Randolph's defamation suit, which centered on a letter Singer wrote to the website Gawker.com in response to a story about the planned book. Court documents available to Reuters did not spell out the reason for the dismissal, but CNN reported the judge found, in part, that the letter has free speech protection under the law.

The book was published three months before two unidentified male masseurs filed sexual assault lawsuits against Travolta, the star of "Grease" and "Saturday Night Fever." Both accusers swiftly dropped their lawsuits in May after doubt was cast on the details of their alleged encounters.

Travolta, 58, has been married to actress Kelly Preston since 1991.

NEW YORK ? Satellite TV company Dish Network Corp. is launching a broadband Internet service that?s aimed at rural areas that don?t currently get high-speed Internet.

Dish Network said Thursday that the satellite broadband service, dishNet, will start at $40 per month for people who bundle it with certain Dish?s TV programming packages. The new service goes on sale Monday.

The company is targeting about 14.5 million Americans who, according to a Federal Communications Commission report, live in rural areas and don?t have access to high-speed Internet. In all, about 19 million people in the U.S. don?t have high-speed Internet service.

The dishNet service will offer download speeds of up to 10 megabytes per second. Dish said this is fast enough for typical Internet uses such as accessing social networks, music or video streaming and Internet telephone services.

Investigational brain cancer vaccine to be tested: Peptide vaccine ...

(Medical Xpress)?A new clinical research study at Roswell Park Cancer Institute (RPCI) will test a first-of-its-kind cancer "vaccine" that may prove effective against many forms of solid-tumor cancers. The vaccine, to be investigated in a trial involving patients with brain cancer, generates an immune response that appears to put the target molecule, the cancer survival protein survivin, into a bind it can't escape.

The peptide vaccine, developed at Roswell Park by Robert Fenstermaker, MD, and Michael Ciesielski, PhD, is based upon a specially engineered small protein molecule called a "peptide mimic." Dr. Fenstermaker is principal investigator of the phase I clinical research study, which will test the safety and immunological effects of the vaccine in patients with two types of brain cancer: glioblastoma multiforme (GBM) and anaplastic glioma. Called SurVaxM, the injectable vaccine will initially be given in four doses to nine patients.

Survivin, produced by at least 80% of cancers, is a protein that helps cancer cells to survive under stressful conditions. It is present only in diseased cells, which are caught in an unwinnable situation when exposed to the vaccine.

"SurVaxM puts cancer cells in a Catch 22," says Dr. Fenstermaker, who is Chair of RPCI's Department of Neurosurgery and Director of the Institute's Neuro-Oncology Program. "The vaccine kills tumor cells that express survivin. If the cells turn survivin off to escape the vaccine, they're essentially committing suicide."

The engineered peptide used in the vaccine is able to stimulate an immune response because the cancer recognizes it as a foreign molecule.

"We arrived at this peptide through reverse immunology," notes Dr. Ciesielski. "We knew we wanted to target survivin because it is expressed by so many tumors. We looked at many survivin peptides trying to find the best one to use as our vaccine. Once we identified one that looked promising, we engineered it to be more potent and produce a better response by enlisting multiple arms of the immune system."

In preclinical studies, the vaccine was effective against several cancers, including gliomas and prostate, ovarian, breast and kidney tumors that produce survivin. Studies in which human glioma, lymphoma and leukemia cells were exposed to the vaccine outside the body also produced a strong response. "In those earlier studies, the response was persistent," Dr. Ciesielski says. "It appears that the vaccine continues to provide lasting immunity after the tumor has been eliminated."

Roughly 15,000 people are newly diagnosed with glioblastomas and anaplastic gliomas in the U.S. every year. These cancers are very difficult to treat, and are often fatal.

"Survival rates for malignant gliomas have improved modestly over the last two decades, but better therapies are desperately needed," Dr. Fenstermaker says. "We're anxious to move ahead with this study and, hopefully, go on to larger studies in the years ahead, but we first have to show that this is a safe and well-tolerated drug for a group of terrible diseases."

Because they enlist the body's own cells to fight cancer, immune-based therapies generally have few adverse side effects. The trial is the fourth clinical research study launched through RPCI's Center for Immunotherapy this year.

Computers match humans in understanding art

ScienceDaily (Sep. 25, 2012) ? Understanding and evaluating art has widely been considered as a task meant for humans, until now. Computer scientists Lior Shamir and Jane Tarakhovsky of Lawrence Technological University in Michigan tackled the question "can machines understand art?" The results were very surprising. In fact, an algorithm has been developed that demonstrates computers are able to "understand" art in a fashion very similar to how art historians perform their analysis, mimicking the perception of expert art critiques.

In the experiment, published in the recent issue of ACM Journal on Computing and Cultural Heritage, the researchers used approximately 1,000 paintings of 34 well-known artists, and let the computer algorithm analyze the similarity between them based solely on the visual content of the paintings, and without any human guidance. Surprisingly, the computer provided a network of similarities between painters that is largely in agreement with the perception of art historians.

The analysis showed that the computer was clearly able to identify the differences between classical realism and modern artistic styles, and automatically separated the painters into two groups, 18 classical painters and 16 modern painters. Inside these two broad groups the computer identified sub-groups of painters that were part of the same artistic movements. For instance, the computer automatically placed the High Renaissance artists Raphael, Leonardo Da Vinci, and Michelangelo very close to each other. The Baroque painters Vermeer, Rubens and Rembrandt were also clustered together by the algorithm, showing that the computer automatically identified that these painters share similar artistic styles.

The automatic computer analysis is in agreement with the view of art historians, who associate these three painters with the Baroque artistic movement. Similarly, the computer algorithm deduced that Gauguin and C?zanne, both considered post-impressionists, have similar artistic styles, and also identified similarities between the styles of Salvador Dali, Max Ernst, and Giorgio de Chirico, all are considered by art historians to be part of the surrealism school of art. Overall, the computer automatically produced an analysis that is in large agreement with the influential links between painters and artistic movements as defined by art historians and critiques.

While the average non-expert can normally make the broad differentiation between modern art and classical realism, they have difficulty telling the difference between closely related schools of art such as Early and High Renaissance or Mannerism and Romanticism. The experiment showed that machines can outperform untrained humans in the analysis of fine art.

The experiment was performed by computing from each painting 4,027 numerical image context descriptors -- numbers that reflect the content of the image such as texture, color and shapes in a quantitative fashion. This allows the computer to reflect very many aspects of the visual content, and use pattern recognition and statistical methods to detect complex patterns of similarities and dissimilarities between the artistic styles and then quantify these similarities.

Pope's butler to face trial on Saturday - Religion News Service

VATICAN CITY (RNS) The Vatican's most sensational trial since the end of the Inquisition might end fairly quickly ? and with a surprisingly light sentence.

Paolo Gabriele, Pope Benedict's former personal butler, goes to trial on Saturday (Sept. 29) for stealing the pontiff's private papers and leaking them to the press. His crime proved a global embarrassment for the Vatican, revealing infighting and allegations of corruption among the secretive top echelons of the Catholic Church.

But, according to professor Giovanni Giacobbe, a Vatican's prosecutor, a conviction carries a maximum jail term of only four years in the lenient legal system of the world's smallest state.

Gabriele was arrested by Vatican police on May 23, and will be tried for ?aggravated theft? together with Claudio Sciarpelletti, a computer technician at the Vatican's Secretariat of State who has been charged with aiding and abetting Gabriele.

After being granted house arrest in late June, Gabriele still lives under surveillance inside the Vatican walls with his wife and three children. Because his job required constant contact with the pope, Gabriele was one of the few lay people to be granted Vatican citizenship and residency.

Gabriele confessed to his crime and, if convicted, would have to serve time in an Italian prison since the Vatican doesn't have its own jail. But many Vatican watchers assume that Benedict would pardon him after the sentence.

During a briefing with reporters on Thursday (Sept. 27), Vatican prosecutor Giacobbe stressed that the Vatican tribunal's three lay judges are ?independent? and not subject to any pressure from church authorities.

?Of course, the pope could decide to intervene at any moment, but so far he has chosen not to,? he said.

The butler's trial will put an unprecedented spotlight on the Vatican's small legal system. Created in 1929 with the birth of the Vatican City State, Giacobbe explained that the tribunal uses Italy's 1913 ?liberal? crime law. Pope Pius XI chose this code over the much more restrictive one introduced by the Fascist regime, which was considered ?not in line? with Catholic values.

According to Giacobbe, the small Vatican tribunal usually handles around 30 cases per year, ?mostly for petty crimes such as pickpocketing in St. Peter's square.? In the past, other high-profile Vatican crimes, such as the 1998 killing of the commander of the Swiss Guards, never actually went to trial.

While it is impossible to predict the trial's duration, Giacobbe stressed that the Vatican legal system doesn't require cross-examining all witnesses in court. ?If neither the prosecutor nor the defendant raise any particular objections or issues, the trial could wrap up quickly,? he said.

Only eight journalists will be allowed in the small, wood-paneled courtroom to cover the trial on a pool basis. No cameras or recording equipment will be permitted.

The trial could shed light on the motives of Gabriele's unprecedented breach of the pope's trust. According to the the 20-page indictment by Vatican judge Piero Antonio Bonnet, the former butler told prosecutors that he was convinced that ?evil and corruption" were "everywhere" in the church, and that he acted as an ?infiltrator? of the Holy Spirit.

His actions led to the publication of several confidential Vatican documents, including some in the pope's own handwriting, in the best-selling book ?Sua Santita? (?His Holiness?) by journalist Gianluigi Nuzzi and in other Italian newspapers.

While it seems clear that Gabriele played a key role in stealing many of the documents and carrying them outside of the Vatican, few Vatican observers think that Gabriele acted alone.

According to the indictment, several unnamed sources, identified only with the letters ?W? and ?X,? supplied him with confidential documents. The former butler himself, in a television interview with Nuzzi taped before his arrest, boasted that "around 20 people across the Vatican" were sympathetic with his actions.

The Vatican prosecutors' investigation on the diffusion of the documents and other potential charges such as ?attempting against the state's security? is still ongoing. A parallel investigation led by three cardinals on Benedict's orders has completed its work but its findings are still unknown.

According to Giacobbe, the pope could decide to supply the tribunal with the cardinals' final report but he isn't obliged to.

Guinea secures $2.1 billion debt relief from IMF, World Bank

CONAKRY (Reuters) - Guinea secured $2.1 billion in debt relief from the World Bank and the IMF Heavily Indebted Poor Countries (HIPC) initiative, paving the way for accelerated development of the minerals-rich West African state, officials said.

The debt relief comes as a vote of international confidence in Guinea's transition back to civilian rule since a 2008 military coup that hampered its economy, discouraged investment, and led partners to freeze aid.

"Reaching the HIPC completion point represents an important achievement for Guinea. It reflects the significant progress made in economic management following the first democratic elections in December 2010," Harry Snoek, IMF mission chief for Guinea, said in the IMF press statement.

Guinea is the world's top supplier of the aluminum ore bauxite and holds rich deposits of iron ore, gold and diamonds, but decades of political turmoil since independence have left most of its people in poverty.

"I applaud the courage of the Guinean people, without whom this important step in restoring the confidence of our partners would never have been possible," President Alpha Conde said in a press release issued by his office.

"This gives us the historic opportunity for a new start."

Conde's office said the debt relief would free up some $150 million a year for programs to combat poverty in Guinea, and would allow the government to raise public salaries by 10 percent starting in October.

Conde won a hotly contested election in 2010, closing the book on nearly two years of military junta rule, but the government has since struggled to set the legislative elections needed to complete the transition.

Conde's regime has taken criticism from human rights groups and the United Nations for heavy-handed security crackdowns on opposition protesters, who claim his government is seeking to rig the parliamentary elections in advance.

TROUBLED TRANSITION

Guinea's Finance Minister Kerfalla Yansane said the debt relief, which clears two-thirds of the country's total foreign debt, will allow the country invest in infrastructure, water, electricity, and food security.

"We must ensure that the daily needs of people are taken care of, but we must also lay the groundwork for longer-term productivity and self-reliance," he said.

He added that Guinea was aiming for double-digit growth within two years on the back of its development projects, up from the IMF's projected 4.7 percent in 2012.

"This is a process that is going to pave the way for better controlled development and we hope that later, in the two years ahead, that we will hit double-digit growth."

Mining firms have signed billions of dollars worth of deals targeting Guinea's reserves, though ongoing political uncertainty, labor strife, and a government review of mining contracts has cooled recent investment.

Guinea said in July that world No. 1 miner BHP Billiton is pulling out of an iron ore project, and a source at Vale said on Tuesday the company was putting its planned Simandou development down its list of priorities.

Yansane said bad governance remained a top threat to Guinea's development plans, which he said was the main reason for the government reviewing existing contracts -- particularly those signed during the military junta rule.

A report by the Paris Court of Accounting seen by Reuters showed that some 1.5 billion euros ($1.93 billion) of contracts were signed by the former military junta under opaque conditions.

"Guinea needs to follow a more democratic path, in consultations, in collaboration, so that we can have a sustainable development and growth that can be shared by all including the poor," he said.

Inflation in Guinea is running at about 14 percent, down from 40 percent in 2006, Yansane said. He added, however, that Guinea's poverty rate has risen to 55 percent in 2010 from 48 percent in 2002. ($1 = 0.7788 euros)

300-million-year-old bugs ? now in 3-D

Researchers have made 3-D reconstructions of two 300-million-year-old insect nymphs by putting the rare fossils under an X-ray.

The scientists have not pinned down the precise identity of either bug, or matched them with their adult counterparts, but they say the scans offer the most complete picture of baby insects from this prehistoric Paleozoic Era.

Both insects are just over 0.8 inches (2 centimeters) long and their fossils, which date to the late Carboniferous period (part of the Paleozoic Era), were found at Montceau-les-Mines in France. The researchers, led by Russell Garwood, of the U.K.'s University of Manchester, published their reconstructions online Sept. 25 in the journal PLoS ONE.

The scientists named one of the insects Anebos phrixos, drawing on the Greek words for "young" and "bristling," the latter of which alludes to the insect's defensive spines. The researchers did not name the other insect, but said it resembles a modern cockroach with a flat body that allowed it to squeeze into narrow crevices and avoid making shadows that might attract predators.

The 3-D reconstructions also gave the researchers detailed pictures of the young insects' mouthparts, which hold clues about their diet. In the roach-like nymph, they found little evidence of specialization in its mandibles, maxilla and other parts, suggesting it ate just about anything.

"Much like modern forest roach nymphs, they could have eaten decaying and rotting matter on the forest floor," the scientists wrote.

Researchers have been turning to CT scans to analyze fossils in a non-invasive way. Another team reported Sept. 18 in the journal Paleontology that they reconstructed a spiny mollusk that crept around the sea 390 million years ago with the same method. Taking their digital reconstruction a step further, they used a 3-D printer to make a physical model of the sea creature. [ See Images of Reconstructed Sea Creature ]

In the book, Schwarzenegger says he had sex with housekeeper Mildred Baena in 1996 in the family guest house while Shriver and their kids were away on vacation and he was in town filming "Batman and Robin."

Schwarzenegger, 65, says that for years he tried to convince himself that Baena's husband was the father of their son, Joseph. But when the boy grew up and the resemblance to Schwarzenegger was so strong, he writes, "I realized there was little doubt that he was my son."

This hiding of the tryst and his secret speculation about his biological son all happened while Schwarzenegger watched as Shriver defended him from allegations of infidelity.

"I am my own woman," Shiver said in a 2003 appearance on "Oprah." "I have not been, quote, "bred," to look the other way."

Schwarzenegger says he kept the affair and the fact that he was Joseph's father a secret partly because he was embarrassed, and also because he didn't want to face up to his wife's family, the Kennedys.

DAMASCUS, Syria (AP) ? Syrian opposition figures who reject foreign intervention in Syria's 18-month conflict called for the ouster of President Bashar Assad at a rare meeting Sunday in the nation's capital. Sunday's opposition conference was attended by diplomats from Iran, Russia and China, Assad's main allies. It was likely to be viewed as likely to be viewed as a cosmetic gesture by Syrian rebels and their many backers in the international community.

Sunday's meeting was organized by the National Coordination Body for Democratic Change in Syria, or NCB, an umbrella for 16 opposition groups with roots in the country.

On Thursday, two senior NCB leaders disappeared after landing at Damascus International Airport, along with a friend who was to pick them up, and the NCB has blamed the regime for the disappearance. The government claimed the three were kidnapped by "terrorist groups," a phrase it uses for rebels.

Despite the incident, the group said participants agreed on the idea of "overthrowing the regime with all its symbols" while emphasizing the need for "peaceful struggle to achieve the goals of the revolution."

"It's our right to meet here in the capital to express our views without being subject to dictates and pressures or to be forced to make concessions," said the NCB's head, Hassan Abdul-Azim, who spent long years in Syrian prisons for his opposition role.

The strong language may be aimed at gaining credibility among Syrians who despise the regime but are weary of civil war.

NCB leaders, most of them traditional leftists, accuse the rebels and the Syrian National Council, a political opposition group based outside Syria, of being beholden to Turkey, which shelters defected Syrian generals and opposition figures, as well as Gulf Arab countries that support the rebels.

The rebels, in turn, accuse the NCB of being cut off from grassroots opposition fighters on the ground. Many rebels look askance at any political plan short of Assad's immediate ouster, seeing it as a play for time.

Ausama Monajed, a Syrian National Council official in exile, said the NCB was letting itself be used for Syrian propaganda purposes.

"Obviously, the regime had a signal to send ... to show that they are open to political dialogue and to sitting with so-called reasonable people," Monajed said. He portrayed the NCB leaders as isolated and lacking support among Syrians.

The statement emerging from Sunday's conference called for an immediate ceasefire accompanied by the full withdrawal of the Syrian army from towns and cities and the release of all political detainees and kidnapped people. The scenario outlined by the participants is similar to a six-point peace plan proposed by the former international peace envoy to Syria, Kofi Annan. That plan ended with Annan quitting the post last month after his cease-fire failed to take hold as violence escalated across the country.

Haitham Manna, a Paris-based veteran dissident who heads the external branch of the NCB, said the Syrian uprising was launched from inside Syria and it was "only natural for us to speak on behalf of the revolution from inside Syria."

He said regime change in the country was inevitable.

"This regime is dead in the hearts and minds of all Syrians ... there must be negotiations on a peaceful transition of power," he said in a telephone interview.

The Russian ambassador in Damascus, Azmat Allah Kolmahmedov, praised the conference, calling it a "direct implementation of the process of reforms launched by the Syrian government, including the freedom of expression."
